Plaintiff Files Motion to Amend Complaint Amid Ongoing Dispute Seeking Treble Damages Over Delayed Wage Payment Order

Phoenix, Arizona Nov 28, 2025 (Issuewire.com)  - A Maricopa County wage payment dispute involving a former Oxford Bank Corporation employee has entered its next procedural phase. The plaintiff has filed a motion for leave to submit a second amended complaint.

The case stems from a prior wage order issued by the Industrial Commission of Arizona (ICA), which directed Oxford Bank Corporation to pay $29,826.25 to the former employee after a finding related to a retaliation-derived wage claim. Payment was reportedly completed after the statutory deadline, prompting the plaintiff to seek treble damages under Arizona wage law.

According to court filings, the Plaintiff’s latest motion seeks to clarify and expand factual allegations based on new information and to address arguments raised in the defendant’s previous motion to dismiss. The filing asserts that further amendment is warranted to ensure “full and fair adjudication of all issues presented under Arizona’s wage protection statutes.”

The motion for leave to file second amended complaint is currently under judicial review by the Maricopa County Superior Court.

“This case has always been about accountability and the principle that workers should not have to battle through multiple procedural hurdles to enforce valid wage orders or when seeking justice,” said the plaintiff. The plaintiff further stated, “I believe this case highlights the impact of delayed wage compliance, which is why I have pursued every available legal remedy.”

Publicly available court and commission records continue to reflect that the ICA order was issued earlier this year and required full payment by March 25, 2025. The employer completed payment on April 7, 2025.
