Mindspa issues warning against Synctuition for trademark infringement

Mindspa, a mental health resource provider, has issued a warning to its app users, stakeholders, and partners regarding an ongoing trademark infringement by app developer Synctuition.

Sofija grad, Bulgaria Mar 18, 2023 (Issuewire.com)  - Mind Solutions Ltd, a Bulgarian-based healthtech startup that developed successful mental health apps such as "Mindspa" and "Gambless", has issued a press release informing its users and partners of a serious trademark infringement by meditation app developer Synctuition OÜ.

According to Mind Solutions' press release, Estonian-based company Synctuition OÜ, now renamed Mindspa OÜ, has rebranded its mobile app using the name Mindspa, a trademark owned by Mind Solutions Ltd.

The company stated that the infringement started back in 2020, while its first Mindspa trademark was deposited at the European Union Intellectual Property Office (EUIPO) in 2019 for goods and services covered in international classes 9 and 41. Mind Solutions said that despite repeated attempts to stop the unlawful use of its mark, including letters from its attorneys and disputes in various trademark offices, it was still unable to stop Synctuition from continuing to use the Mindspa name without permission, and that its commercial use has increased over time. The infringement has since expanded to various products and services, from mobile apps to accessories (such as Airpods cases), from meditation services to office pods/booths featuring sound technology (produced in partnership with another Estonian company, Silen OÜ).

In the press release, customers and partners were also informed of the latest rulings by the EUIPO dated 09 February 2023, in which the Board of Appeal judges decided in Mind Solutions' favour in the cases R 374/2022-1 and R 375/2022-1, preventing Synctuition to register marks similar or identical to 'Mindspa' for goods and services protected by the earlier trademark. 

Mind Solutions Ltd, which invested significant resources and effort into building its Mindspa brand, stated that it does not tolerate any other company infringing on its intellectual property and has assured its users, partners, and stakeholders that it remains committed to providing high-quality mental health resources and services, thanking them for their continued support and loyalty despite the ordeal.
