Madras High Court Restrains EchoRead from Infringing Techindia’s Copyright

Madras High Court has granted Permanent Injunction against EchoRead for infringing Techindia’s copyright in its training materials, and other proprietary material.

Chennai, Tamil Nadu Aug 22, 2022 (Issuewire.com)  - The Commercial Division of the Hon’ble High Court of Judicature at Madras, Chennai; in an action initiated by Techindia Infoway Private Limited (“Techindia”), for Copyright infringement of its proprietary training materials, policies, systems, and processes, etc., viz., EKG Training Material, NDA Employment Agreement, Employee Handbook, Clinical Process and EKG Training Syllabus, has declared Techindia as the author of the above literary works with consequential exclusive copyright in the works and further has granted Permanent Injunction against EchoRead Healthcare Private Limited (“EchoRead”), and all its directors, shareholders, agents, partners, representatives, and employees.

Initially, the High Court had directed the appointment of an independent Advocate Commissioner to conduct a search and seizure of the infringing materials at the registered office of EchoRead.

The Advocate Commissioner with the assistance of the local police found that EchoRead had used a false address as its registered office and was surreptitiously operating at another location. The Advocate Commissioner and Police conducted a search at the offices of EchoRead and found the infringing materials, and filed a detailed report before the Hon’ble High Court.

Based on the report filed, the High Court was pleased to grant an interim injunction against EchoRead and certain identified individuals, restraining them from using Techindia’s proprietary material in any manner whatsoever.

By way of its final judgment and order dated January 20, 2022, the Commercial Division of the Hon’ble High Court of Judicature at Madras has granted all injunctive reliefs sought for by Techindia, against EchoRead, thereby permanently injuncting EchoRead from infringing Techindia’s proprietary material.

During the proceedings, it came to light that EchoRead was falsely using the names and credentials of various persons to bolster its employee records. These persons claimed to have initiated criminal proceedings against EchoRead.

Techindia welcomes the decision of the Commercial Division of the Hon’ble High Court of Judicature at Madras, which decision has confirmed Techindia’s status as the author of its materials and its claims against EchoRead for copyright infringement.
