Chicago, Illinois Jun 16, 2020 (Issuewire.com) - Even though it’s Fathers’ Day weekend, attorney Jeffery M. Leving will tell radio listeners on Saturday about a case involving a client who isn’t a father. It’s his mother, a wonderful grandmother, who’s concerned about her son and his child.

This child in the case is just a baby. According to court documents, the mother appears to have abandoned the child and left the state. The father is a teenager, and he lives at home with his mom. The baby has mainly lived with dad and grandma, but they had no court order that even said that dad was the baby’s father.
Grandma and dad came to Leving for the legal help they desperately needed. Grandma wanted a court order granting her possession of the child, and under the law, people who aren’t parents can be awarded parental rights in certain circumstances. This is difficult, but it can be done. She also wanted decision-making authority, particularly over medical decisions, because even though the little boy is healthy, he will need routine medical care. Her view is that she has a stable home, with her son, the child’s father, and there’s nobody else who offers that level of stability.
This is a complicated case with a lot of moving parts, but the Leving legal team pulled it all together, went before the judge via Zoom on an emergency basis, made a convincing argument – and won. The judge granted Grandma sole possession of the child, as well as parental decision-making authority and access to the child’s health care benefits.
“A key here also is that the father, even though he’s young himself, will be helping his mother raise his little boy and being dad. This is an important victory for this baby, his father, and for Grandma,” Leving said.
