A Chicago dad lived with his children and the children’s mother as a family for over 10 years, was the primary breadwinner for the family, and was actively involved in raising and supporting his children. Now, the children have grown up and are starting lives of their own. Recently, the father was shocked to receive a notice that the mother brought a child support action against him, accusing him of failing to pay child support during the many years they lived together as a family. He feared jail time.
The State of Illinois, without even talking to the father, accepted the mother’s claims that he provided no financial support for his children. The state erroneously determined that dad owed the mother almost $40,000 in child support arrearages, despite the financial support he provided for her and the children when they lived together. The state could have had dad thrown in jail and taken away his driver’s license because of this alleged arrearage.
Desperate, this man sought help from Fathers’ Rights Attorney Jeffery M. Leving, and he got it. Leving put together a legal team to fight this injustice, led by attorney Michael Halusek.
The Leving legal team jumped into action to prevent the state from taking action against dad. Leving argued that the state erroneously determined that dad owed almost $40,000, that dad did not owe any child support arrearage, and that the mother knew all along that dad had no obligation to pay her child support, since he financially supported the children during all the years they lived together.
Leving won, and secured an order reducing dad’s child support arrearage to zero.
This dad did everything right: he was there for his children every day, raising them and supporting them financially, mentally, emotionally, and academically. Yet due to a system that is biased against fathers, dad faced losing his liberty and his license. But failure was not an option, and Leving achieved justice for this devoted dad. Dad walked out of court with his liberty and his dignity.
