Orange, California Mar 28, 2019 (Issuewire.com)  - The American College of Medical Scribe Specialists (ACMSS™) and the American College of Clinical Documentation Outcomes (ACCDO) cannot support the Trump Administration Justice Department’s determination on Monday that a district court judge in Texas came to the correct conclusion when he ruled that the Affordable Care Act (ACA) is unconstitutional and should be struck down. These are federal laws protecting all 50 united states, indiscriminate and indifferent to anyone state law. In respect of constitutional federal laws, federal law is the supreme law of the land.

“That ruling has been delayed pending appeal, meaning that the ACA remains the law of the land, as it should remain,” said ACMSS™ | ACCDO Executive Director Kristin Hagen. “ACMSS™ and ACCDO have long urged lawmakers and the administration to continue to uphold and support the ACA and will continue to do so while working in a bipartisan manner to protect the laws in which they are written and passed through Congress for the people. ACMSS  | ACCDO will continue to support Congress in implementing America's wellness care found through bipartisan legislation and passage of human protections and provisions for the American people who require and share in the needs of evidence-based integrative and preventive medicine and wellness found in ACCDO cures and the proposed bipartisan Medicare for All legislation. Consumers will also require key protections and provisions, upcoming, to ensure short- and long-term automobile safety.

Similar to the ACA, consumers also will require new and upcoming legislation focused on preventive automobile safety, to protect the human body, and that which will modernize consumer safety. Hand-in-hand to the ACA, requiring 'on/off' airbag safety devices wherever an airbag is installed effectively and safely enables all consumers access to their rights, up to and including health and safety features, to take charge of their health, their cost, and their freedom to move on their journey and discovery of health and wellness. Low-cost manual automobile safety 'on/off' safety devices and switches not only are low cost to implement and protect innocent lives. All American's depend on sound legal advice to make their best decisions. Prevention saves American's money, reduces unnecessary financial burdens, and protects the people in which the laws are passed to do. Consumers have rights and choices when it comes to their health, their protections, and their hard-earned daily dollars on what American’s contribute to each year through Medicare to enable new investments, new en roads, and new models of care on the pathway to 21st-century care."

The Texas case claims that because Congress in the 2017 tax bill effectively invalidated the individual mandate, which requires that all Americans have health insurance or face penalties, the entire ACA should be struck down. However, if the Texas case does reach the Supreme Court, the court may not vote to overturn the entire legislation because of the concept of “severability,” which says that an entire law need not be struck down just because one piece of it was judged unconstitutional. This decision by the Trump Administration to support invalidating the ACA is especially troubling because it was made despite the objections of both Health and Human Services Secretary
Alex Azar and Attorney General Bill Barr.

“The ACA is sustainable, and it should not be tampered with, replaced at all, or in its entirety,” said Hagen. “To date, the legislation associated with the ACA has been very resilient to attempts to overturn it—in fact, the Supreme Court has upheld the ACA twice since its inception. At this time, there are zero reasons for trying to bring down a law that has for a decade and continues to be, bring stability and a federal framework to build solutions on and across the U.S health care system. America has long since moved forward into new laws of MACRA and the 21st Century Cures Act that not only create modern breakthroughs and cures today but also bring focus on building the whole persons health care into the clinician’s office and across the US health care system. Both physicians and patients need a modern environment in which to practice and provide sustainable operational solutions to every American in the US health care system. There is no one across America who can be excluded, literally no one under the ACA," said Hagen. "To solo out one minority group is to create an open up additional legal battles that will far extend beyond the boundaries and reach of today's known 'ACA.' 

In the latest (February 2018) Kaiser Health Tracking Poll, researchers found the highest level of favorability for the ACA (54 per cent) among the American public ever in the 80 polls it has conducted since 2010. According to Kaiser data, since May 2017, more people have approved of the ACA than disapproved, and support has been growing. One of the most popular provisions of the ACA—no discrimination by insurance companies because of pre-existing conditions—remains in effect, even though the individual mandate is no longer being enforced because of the 2017 tax bill.

“Donald Trump has vowed to protect people with pre-existing conditions, but by supporting the appeal of the Texas decision, he is not keeping his word,” Hagen said. “Removing protections for pre-existing conditions would mean millions of more people would lose healthcare coverage and would be unable to get the preventive care they need. Preventive medicine is proven to cure and leads all Americans onto an evidence-based and scientific path in which consumers have ample protections to improve their care in their own lives. In bipartisan fashion, it is time to come together, move forward. Problems require solutions and solutions require leadership. Laws are voted in for the protection of the people. Congress is the glue that binds this nation together, and the people are those who govern it. America requires stability in its health care. Laws are established to protect people from undue harm, and they create the infrastructure to support all facets of care, from health care to research, science, and cures. It's time for us to stand up, do what's right, and move this nation productively forward and solve solutions that have a lasting effect. To do otherwise is to deceive the American people through waste, fraud, and abuse. Health care is a right, and it is the only real value anyone can sustainably and reliably look forward to improving, day in and day out.”
